Introduction‍

The Privacy Policy below applies across all websites and applications that we own and operate and all services we provide (these are referred to, collectively, as the services). It describes the standards we adhere to in handling your personal data. Personal data is identifiable information about you, such as your name, address, email address, phone number, date of birth, driver license or passport number, support queries or comments, and so on.

Some of the words and terms we use here are defined in our Terms of Service, so if there’s anything you need clarified, please have a look there.

Your privacy is very important to us, and we may need to update this Privacy Policy from time to time to make sure that it’s kept current. If we make any significant changes, we’ll send you an email to let you know.

1. Who we are

We are Connectworks Limited. Connectworks Limited is the developer of Connectworks, a world-class governance and administration software solution for trusts, companies, and individuals. We’re based in New Zealand, but our services are available to be used from anywhere.

2. Information we collect (and how we collect it)

Connectworks collects your personal data in a number of ways when you use the services. These can broadly be categorised as follows:

Information that comes directly from you. This is the personal data about you that you enter into Connectworks yourself, such as your date of birth or address you record in your personal profile. You can also enter personal data in less obvious ways; for example, by recording your right to live in a property owned by a trust. If you don’t want to provide your personal data, you don’t have to, but it may restrict the function of some parts of the services.

Information we receive from third parties. As a service for managing multi-party entities, it is likely that at least some of the personal data about you that is recorded in Connectworks will have been entered by someone else. At a minimum, your personal profile (which requires your name, email address, and user role) will have been created by someone other than you, in order for you to be invited to use the service. The majority of third-party information will be anything about you that is recorded by the professional advisor who manages your Connectworks subscriptions, but it might also be possible for other kinds of third-party (such as a contact person for your company or trust) to store information about you too.

Information we receive from your use of Connectworks. Some personal data is automatically collected whenever you use the services, such your IP address. Connectworks also collects information on the different activities that users undertake in the service. This is done in order to get a better view on how the services are used, so as to be able to improve Connectworks, and to provide the best user experience available.

Information we receive from your support queries. Whenever you lodge a support query we collect your name and email address in order to be able to reply to you and provide the support or advice requested.

3. How we use your information

Most of the information Connectworks collects is used simply to provide the services you’ve requested, and to allow your companies and trusts to be managed as part of our service. We also use your personal information for other purposes which include the following:

To provide product support. Whenever you lodge a support query Connectworks collects your name and email address, in order to be able to reply to you and provide the support requested.

To improve our services. Connectworks collects information on how you use Connectworks (such as the activities you perform andhow you navigate through the service) in order to track how our users interact with the service. This is done to improve and optimise the services and to create a better user experience.

To communicate with you. Connectworks collects information on people with certain user roles in order to be able to communicate with them when they are experiencing technical difficulties or to alert them of new features or developments. Connectworks will periodically collect the names and email addresses of all such users in order to make this communication possible.

To keep Connectworks secure. Connectworks tracks how you access the platform in order to help detect and prevent any fraudulent or malicious activity.

4. How we share your information

In the ordinary course of business Connectworks doesn’t directly share your personal data with anyone else. However, anyone that has been granted access to the Connectworks workspaces of companies or trusts you are involved in will be able to view elements of the personal data recorded in your Connectworks profile. In most cases, this access will be granted by the professional advisor (or other person or company) that manages your Connectworks subscriptions, but there are occasionally instances when Connectworks is requested to facilitate this access on the subscriber’s behalf.

Whenever you accept an invitation to access Connectworks (or a new workspace in Connectworks) information in your profile will also be visible on an ongoing basis to the party that created that invitation. (Note that a “party” in this sense may consist of more than one actual person; for example, where an invitation to Connectworks is extended by a professional services firm, your profile may be visible to a number of staff members that belong to that firm). A list of all the parties that have such access to your data is contained in your personal profile. If you want to revoke the access of any party to your data, you can do so from your personal profile, though we recommend contacting the party first.

Connectworks might also share elements of your personal data with regulators, law enforcement bodies, government agencies, courts or other third parties where it is considered necessary to comply with applicable laws or regulations, or to exercise, establish or defend Connectworks’ legal rights. Where possible and appropriate, Connectworks will notify you of this type of disclosure.

5. International data transfers

Because Connectworks services are available worldwide, your information may be transferred to, and processed in, countries other than the country you live in, including Australia and Singapore, where Connectworks’ data hosting providers' servers are located.

For individuals in the European Economic Area (EEA), this means that your information may be transferred outside of the EEA. Where your personal data is transferred outside the EEA, it will only be transferred to countries that have been identified as providing adequate protection for EEA data, or to a third party where we have approved transfer mechanisms in place to protect your personal data.

6. Storage and Processing

The personal data Connectworks collect may be stored and processed in any country in which Connectworks affiliates or service providers maintain facilities. If you are located in the EEA or other regions with laws governing data collection and use, please note that Connectworks may transfer information, including personal data, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to any country in which Connectworks’ affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

7. Cookies and tracking technologies

Connectworks utilises 'cookies' and other technologies to enhance and efficiently provide our services when you make return visits to the service. A cookie will not provide any information which identifies you, but operates to identify the computer you use to access Connectworks. If you want to you may set your browser to allow or reject the receipt of a cookie.

We may also collect log file information about your browser or mobile device each time you access our services. Log file information may include anonymous information such as your web request, Internet Protocol (IP) address, browser type, information about your mobile device, referring / exit pages and URLs, number of clicks and how you interact with links on the service, domain names, landing pages, pages viewed, and other such information. We also collect information from emails that are sent or generated from the services, which may include personal data such as your name, email address, or title.

8. Retention

Connectworks will only retain your personal data for as long as necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, Connectworks consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which Connectworks process your personal data and whether those purposes can be achieved through other means, and the applicable legal requirements.

In some circumstances Connectworks may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case Connectworks may use this information indefinitely without further notice to you.

9. Your rights

Under data protection laws, you may have certain rights in relation to your personal data. These rights may include the following:

• The right to request access to the personal data we hold about you;
• The right to request the personal data we hold about you to be corrected, or erased under circumstances where there is no legitimate reason for us to continue holding it;
• The right to object to our continued processing of personal data;
• The right to request us to restrict or suspend the processing of your personal data;
• The right to request the transfer of your personal data to another party;
• The right to withdraw the consent you have given to our collection, holding, or processing of your personal data, as stated in the terms of this Privacy Policy.
